Reprise, Inc. (“Reprise,” “we,” and/or “us”) offers you this privacy notice (“Privacy Policy”) to disclose our efforts in respecting and maintaining your privacy choices when using our website or our products and services (collectively, the “Services”). By using our Service, you acknowledge your receipt of this Privacy Policy. Please review this Privacy Policy carefully as it pertains to your rights regarding your personal information.

Personal Information We Collect

We collect personal information about you through the following methods and sources:

Information You Provide to Us

Registration. When you register for an account to access our products or services, we may ask for personal information such as your email address.

Your Recordings. When you use our Services that enable you to create recordings of your activities on websites, we collect those recordings, including the content, information and materials depicted in those recordings.

Communications. If you contact us directly, we may receive additional personal information about you. For example, if you email our support team, we will receive personal information such as your name, email address, the contents of your message, any attachments you may send to us, and any other personal information you choose to provide.

Indirect Collection. Our service providers may collect personal information about you and share it with us for purposes of hiring, sales, marketing, partnerships and similar activities. Our service providers should disclose that they are sharing your personal information with us at the time of their collection. Also, our customers may share your personal information with us in order that we may provide them with the Services.

You may opt out of receiving marketing communications from us by clicking the unsubscribe button on the bottom of any of our marketing emails.

Personal Information We Collect When You Use Our Services or Website

Personal Information from Cookies and Similar Technologies. We collect personal information using cookies, pixel tags, or similar technologies. Cookies are small text files containing a string of alphanumeric characters. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to our Services. Device Information. We receive personal information about the device and software you use to access our Services, including your internet protocol (IP) address, web browser type, operating system version, phone carrier and manufacturer, device identifiers, and mobile advertising identifiers.

Usage Information. To help us understand how you use our Services and to help us improve them, we automatically receive personal information about your interactions with our Services, such as the pages or other content you view, the recordings you make, and the dates and times of your visits.

How We Use Your Personal Information

  • To understand and analyze how you use our Services;
  • To communicate with you, provide you with updates and other information relating to our Services, provide information that you request, respond to comments and questions, and otherwise provide user support;

How We Share Personal Information

We may share personal information we receive from or about you or your devices as described below:

Vendors and Service Providers. We may share any personal information we receive with vendors and service providers retained to help us provide our Services.

As Required by Law and Similar Disclosures. We may access, preserve, and disclose your personal information if we believe doing so is required or appropriate to: (a) comply with law enforcement requests and legal process, such as a court order or subpoena; (b) respond to your requests; or (c) protect your, our, or others’ rights, property, or safety.

Merger, Sale, or Other Asset Transfers. We may transfer your personal information to service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company or we sell, liquidate, or transfer all or a portion of our assets.

Consent. We may also disclose your personal information with your permission.

How Long We Store Your Data

Reprise will store your personal data as long as needed to provide you with our Services and to operate our business. If you ask Reprise to delete specific personal information from your account (see Your Rights section below), we will honor this request unless deleting that information prevents us from carrying out necessary business functions, such as billing for our services, calculating taxes, or conducting required audits.

Third Parties

The Services may allow you to, upon your direction, export personal information to third party services. We are not responsible for the practices of these third parties. Please be aware that this Privacy Policy does not apply to your activities on these third party services or any personal information you disclose to these third parties. We encourage you to read their privacy policies before providing any personal information to them.

Security

Reprise has, designed a commercially reasonable information security program that incorporates technical, administrative and organizational measures that provide a level of security appropriate to the level of risk of possible unauthorized or unlawful processing, accidental loss of and/or damage to your personal information. At least annually, Reprise conducts a risk assessment of the effectiveness of these technical, administrative and organizational measures for ensuring the security of the processing.

Children

We do not knowingly collect, maintain, or use personal information from children under 13 years of age, and no part of our Service is directed to children.

International Transfers of Data

Our Services are hosted in the United States. If you choose to use our Service from the European Union or other regions of the world with laws governing personal data collection and use that may differ from U.S. law, then please note that you are transferring your personal information outside of those regions to the United States for storage and processing. Also, we may transfer your personal data from the U.S. to other countries or regions in connection with the storage and processing of personal data, fulfilling your requests, and operating the Service. By providing any information, including personal information, on or to the Services, you consent to such transfer, storage, and processing.

European Privacy Law Compliance

Reprise may be a data controller or a data processor depending on the way we receive your personal information. For example, if you submit your personal information directly to us through the website or a contact form, then we are considered a data controller under the EU General Data Protection Regulation, and all other applicable EU, EEA or European single market Member State laws or regulations. If you are a Reprise customer and data controller and we process personal data as instructed by you, then please review our Data Processing Agreement located at https://www.reprise.com/dpa/

If you are from a region that requires a legal basis for processing personal data (such as the EEA or the UK), our legal basis for collecting and using the personal information described above will depend on the personal information concerned and the specific context in which we collect it.

However, we will normally collect personal information from you only where we need the personal information to perform a contract with you, or where the processing is in our legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms, or where we have your consent to do so. In some cases, we may also have a legal obligation to collect personal information from you or may otherwise need the personal information to protect your vital interests or those of another person, such as in the case where we request personal information from you in the context of a government audit or in response to a request from law enforcement. Reprise does not use automated decision-making for purposes of providing the Services.

Where our collection of your personal information is on the basis of legitimate interest, a contract or vital interests it can be used for another purpose but only after checking that the new purpose is compatible with the original purpose. If we collected your personal information on the basis of consent, then there will be no further processing without your consent.

United States Privacy Law Compliance

Reprise may also be subject to U.S. laws and regulations that apply to processing of personal data including, but not limited to, the California Consumer Privacy Act, as amended “CCPA,” including as modified by the California Privacy Rights Act of 2020, the Virginia Consumer Data Protection Act, the Colorado Privacy Act, the Connecticut Personal Data Privacy and Online Monitoring Act, the Iowa Consumer Data Protection Act, and the Utah Consumer Privacy Act, all upon their respective enforcement dates. Your Rights regarding Your Personal Information that We Collect

While the privacy laws and regulations are constantly changing, Reprise is committed to using processes and procedures that comply with such laws. According to current laws, you may exercise certain rights provided below:

The Right to Know. Certain privacy laws require that Reprise disclose to you the categories or pieces of personal information Reprise collected about you, the purposes for which it was used, the categories of third parties who we disclosed the personal information to and if we sell your personal information. You can make this request up to two times per year, free of charge.

Rectification; Correction. Certain privacy laws require that Reprise offers you an opportunity to rectify or correct any personal information we hold about you in our systems.

Erasure; Deletion; Data Retention. Certain privacy laws require that Reprise will comply with your request for erasure or deletion of your personal information, unless Reprise requires a record of your personal information for legitimate business purposes, such as backups that have not yet been deleted which are maintained for security. You may also request that Reprise passes along your request to its third parties, suppliers and subprocessors.

Limitation of Use or Disclosure; Sharing; Purpose Limitation; Data Minimization. Certain privacy laws require that Reprise complies with your request to limit the use or disclosure of your personal information in our systems or that we do not share your personal information with third parties upon your request.

Objection/ Opt-out. Certain privacy laws require that Reprise honors your request to object or opt out of Reprise’s use of your personal information, sale of your personal information or sharing of your personal information, even if you have previously given consent.

Data portability; Access. Certain privacy laws require that Reprise provide you with a copy of your personal information held in our systems that you may then download and retrieve for other purposes.

Automated Decision-Making (including profiling). Certain privacy laws require that Reprise complies with your request not to use your personal information for automated decision making, which means a decision made by computers without a personal connection.

Right to Lodge a Complaint. Certain privacy laws, particularly the GDPR, provide with the right to lodge a complaint with a supervisory authority, in the member state of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of personal data relating to you infringes the regulation.

In order to exercise your rights listed in this Privacy Policy, Reprise must verify that you are the true owner of the personal information in order to comply with its security obligations. Please include in your request specific information regarding your use of the Reprise website or Services, if you have a login, approximately when you submitted personal information into the Reprise platform and a secure method in which Reprise may contact you. Reprise reserves the right to utilize any method, so long as it is in accordance with privacy laws and best security practices, to verify your identity before releasing any personal information to you. Other Privacy Law Compliance.

Changes to the Privacy Policy

We will post any adjustments to this Privacy Policy on this page, and the revised version will be effective when it is posted. If we materially change the ways in which we use or share your personal information previously collected from you through the Services, we will notify you through the Service, by email, or other communication.

What’s Changed Since Our Last Privacy Policy.

Our last privacy policy was published in 2020. Since then, many new privacy laws have come into effect so this Privacy Policy has been updated to reflect our compliance with those laws and regulations. In addition, Reprise’s service offerings have expanded and the business has grown, so some of our collection practices have correspondingly changed.
